I am planning to file divorce in a month. I am separated from one year. How long does it take to finalize ?

We have a child together , and the child stays wth me. I feel we may have custody problems. Taking the above into account, howl long generaly does divorce proceedings take

Alot of states it's 90days. If you two could reach an agreement without fighting too much, it would go smoother. I know a lady that's husband gave her hell and it too over 2 yrs. Mine was easy, it only took 90 days, Good Luck
Reply:First of all, splitting the assets must be equal. I would sort it outside of courts with lawyers. Be fair and ask for what is rightly yours. However, this deal is final. Child support, to me, is antiquated. If you have a job and get a settlement and the government pays for daycare, etc. then you don't need child support. If you ask for custody you will then be responsible primarily for the financial wellbeing of the children. If you don't like this idea, remember it is a double standard to ask for primary custody while sticking the bills to the other (former) spouse. Marital dissolution is marital dissolution. Any issues must be resolved at that time and then left buried in history, where they belong. Joint custody is a fair bargaining point that encourages mutual involvement and doesn't discriminate against men.

Reply:It could take anywhere from 6 months to 6 years depending upon the custody problems as well as separation of property, support issues etc. It's not going to happen overnight. My divorce was over in less than 6 months from separation but there were no "issues" to battle over.
Reply:Depends on how much is involved.It only took me 5 months and we have a child together.We had to go to a parenting class also.But i didn't ask for anything but my maiden name back.Guess it depends on what state you live in also.
Reply:It really depends on the state and the details of the divorce decree. There is no "pat" answer. It depends how long it takes for you and your soon to be ex to hammer out an agreement.

Reply:This varies from state-to-state and can take anywhere from 6 months on up to become final. Custody issues can drag it out longer. Check with your attorney.
Reply:all states are different- in ohio if both parties are agreeable it can happen in 45 days
